1. Seller
Les Bijoux de Marie (trade name "Les Bijoux de Marie"), Rue de l'indépendance 146, 7110 Strépy-Bracquegnies, Belgium · BCE BE0552960772 · VAT BE0552960772 · info@lesbijouxdemarie.be · +32 476 73 50 71. Hereinafter "the shop".
2. Scope
These terms and conditions apply to any order placed on lesbijouxdemarie.be, by a consumer or a professional. Placing an order implies their unconditional acceptance; they prevail over any other document, except by specific written agreement (notably for corporate orders on quotation).
3. Products
The products are handcrafted food items (chocolates, pralines, pastries, ice cream, seasonal creations): photographs are non-contractual and slight variations in appearance are normal. Allergens are listed on each product page; the workshop handles tree nuts, milk, eggs, gluten, soya and peanuts. In case of allergy, please contact us before ordering. Offers are valid while stocks last; some seasonal creations may only be collected on the dates indicated on their page.
4. Order
Orders are placed online via a customer account: cart, selection of collection slot, payment method, summary, confirmation. A confirmation email with full details is sent immediately. The shop may refuse or cancel an order in the event of stock depletion, a manifest pricing error, a prior dispute or suspected fraud; the customer is informed by email and refunded any sums paid.
5. Prices
Prices are shown in euros, inclusive of all taxes (Belgian VAT of 6% on food products, 21% on alcoholic beverages).
6. Payment
Depending on the payment methods available: at the counter upon collection (cash, card, Payconiq), by bank transfer (the order is prepared upon receipt, within the stated period), or online by card and Bancontact via a secure provider (Stripe, Mollie). An order by transfer not paid within the stated period is cancelled following a reminder.
7. In-store collection
Collection is free of charge, on the chosen day and time during opening hours, after the stated preparation time. A collection code is provided. An order not collected within 48 hours of the slot may be cancelled, as fresh products cannot be kept; sums paid remain acquired for perishable products prepared specially.
8. Order collection
Orders placed online are to be collected free of charge in store, in La Louvière, at the slot indicated when ordering. No delivery or dispatch is offered at present. Some seasonal products have their own collection period, specified on their page and in the confirmation email.
9. Right of withdrawal
In accordance with Article VI.47 of the Belgian Code of Economic Law, the consumer has a 14-day period to withdraw from a distance purchase, except for goods liable to deteriorate or expire rapidly (Art. VI.53, 4°), which applies to chocolates, pastries and ice cream, and for goods made to the consumer's specifications or clearly personalised (Art. VI.53, 3°). The right of withdrawal therefore does not apply to our food products; it applies to non-personalised, non-food items (for example a mug), to be returned in perfect condition at your expense.
10. Warranty and complaints
The shop guarantees the conformity of its products. Any complaint should be addressed to info@lesbijouxdemarie.be, via the messaging system in your customer space or the contact page, within 48 hours of receipt for fresh products. Depending on the case, the product is replaced, a credit note is issued or the amount is refunded.
11. Loyalty and promo codes
Carats are credited upon completion of each order and entitle you to the perks announced in the customer space; they have no monetary value and are neither transferable nor refundable. Promo codes have a validity period, conditions (minimum amount, products) and cannot be combined unless otherwise stated.
12. Personal data
Data processing is described in the privacy policy.
13. Applicable law and disputes
These terms are governed by Belgian law. In the event of a dispute, the consumer may have recourse to the Consumer Mediation Service (mediationconsommateur.be) or the European Online Dispute Resolution platform. Failing that, the courts of the Hainaut (division Mons) district shall have jurisdiction.
